1. MOOONE ONLINE STORE TERMS & CONDITIONS

§1. General Information

  1. The MOOONE online store, available at mooone.eu, is operated by:

hereinafter referred to as the “Seller”.

  1. These Terms & Conditions set out the rules for using the Store, placing and processing orders, making payments, delivery, withdrawal from the contract and submitting complaints.
  2. Before placing an order, the Customer has the opportunity to read and accept these Terms & Conditions.

§2. Placing Orders

  1. Products available in the Store, together with their prices and descriptions, are displayed at mooone.eu.
  2. An order is placed by selecting a product and its variant, adding it to the cart, providing the information required to process the order, selecting a delivery and payment method, and confirming the order.
  3. The sales contract is concluded once the Customer successfully places an order and receives confirmation that the order has been accepted.
  4. The Seller sends confirmation of the order to the email address provided by the Customer.
  5. Information regarding the estimated dispatch time, including information concerning products offered on a pre-order basis, is provided on the relevant product page.

§3. Prices and Payments

  1. All prices displayed in the Store are stated in the currency indicated during the purchase process and include all taxes required under applicable law, where applicable.
  2. The total price of the order, including any applicable delivery charges, is presented to the Customer before the order is placed.
  3. Available payment methods are displayed during checkout.
  4. Payments may be processed by third-party payment service providers available through the Store.

§4. Delivery and Pre-Orders

  1. Orders are delivered to the address provided by the Customer during checkout.
  2. Available delivery methods and their costs are displayed before the order is finalized.
  3. In the case of products marked as PRE-ORDER, the order concerns a product that will be dispatched within the timeframe stated on the relevant product page.
  4. The estimated dispatch time for the Starfall Puffer is [E.G. 2–4 WEEKS], unless otherwise stated on the product page.
  5. The stated timeframe is an estimated dispatch period. In the event of a delay, the Seller will inform the Customer of the delay and provide an updated estimated timeframe for fulfilment.
  6. A product's pre-order status does not limit any statutory rights available to the Customer under applicable consumer protection law.

§5. Right of Withdrawal

  1. A consumer who enters into a distance contract online generally has the right to withdraw from the contract within 14 days of receiving the product, without providing a reason.
  2. To exercise the right of withdrawal, the Customer must inform the Seller of their decision through an unequivocal statement, for example by contacting:

  1. The Customer may use the model withdrawal form provided by the Seller; however, use of this form is not mandatory.
  2. After notifying the Seller of the withdrawal, the Customer must return the product without undue delay and no later than 14 days from the date on which the Seller was informed of the withdrawal.

  1. The Customer bears the direct cost of returning the product in the case of a standard withdrawal from the contract, unless the Seller has agreed to bear such costs or applicable law provides otherwise.
  2. The Customer may be liable for any reduction in the value of the product resulting from handling the product beyond what is necessary to establish its nature, characteristics and functioning.

§6. Refunds

  1. In the event of a valid withdrawal from the contract, the Seller will refund all payments due to the Customer in accordance with applicable law.
  2. The refund will be made using the same payment method used by the Customer for the original transaction, unless the Customer expressly agrees to another method that does not result in additional costs for the Customer.
  3. The Seller may withhold the refund until the returned product has been received or until the Customer provides evidence that the product has been sent back, whichever occurs first.

§7. Complaints – Lack of Conformity with the Contract

  1. The Seller is liable to consumers for a lack of conformity of the product with the contract in accordance with applicable consumer protection laws.
  2. The Seller's statutory liability for a lack of conformity generally applies for 2 years from the date the product is delivered to the Customer.

  1. To facilitate and speed up the complaint process, the Customer is encouraged to provide the order number, a description of the issue and, where helpful, photographs showing the issue.
  2. The absence of a receipt does not prevent the Customer from submitting a complaint if the purchase can be demonstrated by other means.
  3. In the event of a lack of conformity of the product with the contract, the consumer is entitled to the remedies provided by applicable law, including, in particular, the right to request repair or replacement and, where provided for by law, a price reduction or withdrawal from the contract.
  4. The Seller will respond to a consumer complaint within 14 days of receiving it.
  5. Costs associated with a justified complaint concerning a lack of conformity of the product with the contract will be borne by the Seller in accordance with applicable law.

§8. Damage Caused by the Customer

  1. The Seller's statutory liability concerns a lack of conformity of the product with the contract and does not mean that the Seller is responsible for every type of damage that may occur while the product is being used.
  2. Damage resulting solely from improper use, actions or accidents caused by the Customer, or use of the product contrary to its intended purpose does not in itself constitute a lack of conformity of the product with the contract.
  3. Nothing in this section excludes, restricts or otherwise affects the consumer's statutory rights.

§9. Personal Data

  1. Customers' personal data is processed for the purpose of fulfilling orders and for other purposes specified in the MOOONE Privacy Policy.
  2. Detailed information regarding the processing of personal data is available in the MOOONE Privacy Policy.

§10. Final Provisions

  1. Contracts concluded through the Store are governed by applicable law.
  2. Nothing in these Terms & Conditions is intended to exclude or restrict any consumer rights arising from mandatory provisions of applicable law.
